The Packaging Act (VerpackG), which replaced the Packaging Ordinance on 1 January 2019, also created the Central Agency Packaging Register (ZSVR). As a public authority subject to technical and legal supervision by the Federal Environment Agency, the Central Body is responsible for the control of distributors and for monitoring the dual systems.
The task of the ZSVR is also to develop a minimum standard for measuring the recyclability of packaging - and therefore to provide a transparent and standardised instrument for determining recyclability.
Since 1 July 2022, all manufacturers of packaged products have been required to register in the LUCID Packaging Register. This change particularly affects transport packaging, sales packaging and secondary packaging in the commercial sector, as well as reusable packaging (pursuant to Section 9(1) of the German Packaging Act, VerpackG). Final distributors of service packaging are also required to register with the Central Agency. This means: even if a supplier of service packaging takes on the system participation obligation, you—for example snack bar operators, butchers, pizza makers or self-employed retailers—must still register with the Central Agency as well (pursuant to Section 9(2) sentence 2 VerpackG).
Registration of packaging that is not subject to the system participation obligation has been possible since 4 May 2022 on the website of the Central Agency Packaging Register.
If a manufacturer does not fulfil his product responsibility for packaging and does not comply with his system participation obligation, the Central Agency comes in play: as a control body, one of the important tasks of the packaging register LUCID is to control the distributors and to ensure a fair and transparent share of the costs for the take-back and recovery of packaging.
A strict approach by the packaging register is important for all first-time distributors, because: not fulfilling one's producer responsibility, which means not participating one's packaging in the dual system, leads to distortions of competition, as the registered distributors share the disposal costs for all packaging placed on the market.
